These Terms of Sale govern any paid purchases offered within the Plumm app, published by NEW GAME (SAS). As of today, Plumm is free: these terms will apply to premium offers as soon as they are available.
1. Purpose and scope
These Terms of Sale govern the sale of premium subscriptions and options offered in the Plumm app, published by NEW GAME (SAS, Paris RCS 105 490 080, registered office 66 avenue des Champs-Élysées, 75008 Paris; hello@plumm-app.com), to anyone acting as a consumer.
Premium purchases are concluded and billed through the App Store (Apple) or the Google Play Store (Google), which act as the seller or payment intermediary for these transactions. NEW GAME publishes the app and provides the premium features. Any subscription implies acceptance of these Terms of Sale as well as the conditions of the relevant platform.
2. Offers and prices
Plumm's core features are and will remain free. Premium features may be offered as a subscription (monthly or yearly) or a one-time purchase.
Applicable prices are shown in the app at the time of purchase, in euros including all taxes. They may vary by country and platform; the price shown before confirmation prevails.
If the price of an ongoing subscription changes, you are informed in advance and may refuse it by cancelling before the next renewal; otherwise, the new price applies to the following period.
3. Order and payment
Purchases are made exclusively through the app stores: the App Store on iOS and the Google Play Store on Android. Payment is processed by Apple or Google depending on your platform, under their own terms. NEW GAME does not collect or store any bank card data.
Order confirmation is provided by the relevant app store.
4. Right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content supplied immediately after purchase, where you have expressly consented to immediate performance and waived your right of withdrawal — which you do by activating the subscription.
Refund requests are governed by the App Store or Google Play Store policy and must be addressed to them directly.
5. Renewal and cancellation
Subscriptions renew automatically at the end of each term by tacit renewal, unless cancelled before the renewal date. In accordance with Articles L.215-1 et seq. of the French Consumer Code, you may at any time choose not to renew your subscription. You can manage or cancel it free of charge, at any time from your App Store (Apple) or Google Play (Google) account settings. Cancellation takes effect at the end of the current period, with no refund for the period already started.
6. Warranties and liability
Plumm remains a cycle tracking tool and not a medical device (see our Terms of Service). Premium features offer no guarantee of medical results.
You benefit from the legal guarantee of conformity under Articles L.224-25-1 et seq. of the French Consumer Code for digital content and services: NEW GAME must provide a compliant service and, in the event of a lack of conformity, bring it into conformity at no cost. For a service supplied continuously (subscription), this guarantee applies throughout the supply period. It is exercised with NEW GAME (hello@plumm-app.com), independently of Apple's or Google's refund policies.
7. Governing law and mediation
These Terms of Sale are governed by French law. In the event of a dispute, first write to us at hello@plumm-app.com to seek an amicable solution. In accordance with Articles L.611-1 et seq. of the French Consumer Code, you may then use a consumer mediator free of charge; the details of the mediator NEW GAME is affiliated with will be set out here once the paid offer is launched. Failing amicable resolution, the dispute may be brought before the competent courts.
